I believe that is what COPPA prohibits, yes. Specifically, the parents would have to consent to the service collecting this information. Even if it's unintentionally being collected from someone younger than thirteen years of age, I do believe that if that were the case, it would still violate the law. Nonetheless, I am not an expert either.
